Lindsey EastwoodLindsey Eastwood is an experienced trial lawyer who specializes in Probate and Estate Administration; Guardianship and Conservatorships; Wills, Trusts, and Estate Planning; and Civil Litigation. She understands the stress associated with Probate and Trust disputes. She provides excellent legal services to her clients and reasonable and predictable fee structures. She takes a compassionate approach to handling your legal affairs.

Lindsey has a strong background in writing and composition that enables her to excel at drafting pleadings in probate matters, estate and trust administration, and estate planning documents, such as wills and trusts. Her writing talent in motion practice is a significant benefit of retaining her as counsel. In addition to her writing skills, Lindsey is also a very successful litigator in civil and probate courts. She recently obtained a $500,000 settlement in a beneficiary designation dispute over capacity and $111,000 judgment in a contested probate fraud case. She also has many successful jury verdicts in trial in Jefferson and Madison County.
Lindsey routinely handles adversarial estates where there are disputes between heirs, breaches of fiduciary duty, malfeasance in estates and trust administration, will contests, disputes in guardianships and conservatorships, and other contentious matters. Her knowledge of probate procedures between Alabama Counties with equity jurisdiction in Probate Courts and those without is a significant advantage to retaining her as counsel.
Before starting her own practice, Lindsey worked for some of the top trial lawyers in Alabama, which gave her the benefit of taking numerous depositions and successfully trying jury trials. Her litigation experience helps her evaluate cases with a "big picture" mentality and maximize returns whether a jury trial is needed. On occasion, she also resolves cases through mediation and arbitration, which can sometimes be cost-saving. A key focus of her practice is also estate planning, wills, trusts, estate and probate administration, and civil litigation, which involves drafting legal instruments and trial work. Lindsey is licensed to practice in all state courts in Alabama, the U.S. District Court for the Northern District of Alabama, and the Eleventh Circuit of the United States Court of Appeals.
Lindsey lives in Hoover with her husband and two daughters. She and her family attend Pleasant Hill United Methodist Church. Lindsey is active in her children's schools, the Hoover community, and various nonprofits.
Lindsey earned her J.D. from Cumberland School of Law, where she was a finalist in the Donworth Moot Court Competition. Prior to law school, Lindsey attended Birmingham-Southern College where she received a B.A. in English and a minor in classics. At Birmingham-Southern, Lindsey was also an active member of the Student Government Association and Alpha Omicron Pi Women’s Fraternity.
Lindsey serves as Chairperson of the Birmingham Bar Association's Probate Section and a member of the Executive Committee of the Birmingham Bar Association. She is a member of the Estate Planning Council of Greater Birmingham, the Elder Law Section and the Real Property and Probate and Trust Section of the Alabama State Bar, the Solo & Small Firm Practitioner Section in addition to the Probate Section of the Birmingham Bar Association, and the Shelby County Bar Association.

Ashley enjoys legal research and the challenge of applying her findings to legal arguments. In her first two years of practice, Ashley successfully objected to creditor claims totaling over $130,000.00, which resulted in creditor claims being disallowed or withdrawn, ultimately saving estates time and money and distributing more money to estate beneficiaries. Ashley drafts various pleadings, motions, discovery requests, legal memorandums, objections to claims, claims against estates, inventories, accountings, proposed orders, estate planning documents, and deeds. Ashley brings a hands-on approach to every case and vigorously advocates for our clients. Ashley focuses primarily on opening, administering, and closing estates as well as guardianships, conservatorships, and estate planning matters. Ashley has consistently proven to be an invaluable asset to our firm.
Ashley also clerked for the late Honorable Anne Lamkin Durward of the 10th Judicial Circuit of Alabama, Domestic Relations Division. Ashley’s domestic relations experience, particularly with common law marriage, settlement agreements, and support modifications, is advantageous to our firm and our clients as domestic relations issues often intermingle in probate cases.
At Cumberland School of Law, Ashley was a member of the Alabama Student Bar Association, Women in Law, Christian Legal Society, Cumberland Public Interest & Community Service Organization, and First-Generation Law Students Organization. Ashley was awarded the Scholar of Merit for Mortgages and Securities. Prior to law school, Ashley graduated with honors from Troy University summa cum laude with her Bachelor of Science in 2019.
